Terms and conditions
§ 1. General Provisions

Share capital: 5,000.00 PLN
hereinafter referred to as the Seller. - The party making purchases in the Store may be a natural person, a legal person, or an organizational unit without legal personality, which has legal capacity under separate regulations, hereinafter referred to as the Buyer.
- Placing orders in the Store is carried out according to the rules specified in these Terms and Conditions. By placing an order, the Buyer accepts the provisions of these Terms and Conditions.
§ 2. Subjects of the Transaction
- The subjects of the transaction include the products presented in the Store at the time of placing the order, together with their original packaging (excluding products from the outlet section).
- All product prices presented in the Store are expressed in euros and include VAT (gross prices). Prices do not include delivery costs.
- All products presented in the Store are brand new and unused. The Seller is obliged to deliver goods free from defects.
§ 3. Placing Orders
- Orders are placed using the appropriate order form available on the Store‘s website.
- Sending an order via the order form available on the website https://www.bobuxpolska.pl/EN/ constitutes a declaration of intent to conclude a Sales Agreement with HYPER sp. z o.o. in accordance with these Terms and Conditions.
- The agreement is considered concluded at the moment the Seller confirms acceptance of the order.
§ 4. Order Fulfillment
- Order processing begins after the order is accepted and payment is made.
- Order confirmation is sent by the Seller via email to the address provided by the Buyer in the order.
- The order fulfillment time is up to 5 business days from the date of confirmation of order acceptance by the Seller.
- The Seller accepts orders 24 hours a day, all year round. Orders placed on Sundays and public holidays will be processed on the next business day.
- If an item is out of stock and this may extend the order fulfillment time, the Buyer may agree to the extended period, choose a similar product, or cancel the order.
- If the Buyer does not agree to extend the order fulfillment time, the order will be canceled and any advance payments refunded immediately via bank transfer to the account indicated by the Buyer.
- For each transaction, the Seller provides proof of purchase in the form of a receipt or a VAT invoice, as requested by the Buyer.
§ 5. Payment Methods
Payment for the ordered goods may be made as follows:
1. By bank transfer prior to shipment to the following account:
- Payment in EUR, account: PL88 1050 1070 1000 0090 8337 7094, SWIFT: INGBPLPW (ING BANK ŚLĄSKI)
2. Electronic payment (e-transfer)
3. Gift card, valid for 12 months from the date of purchase.
§ 6. Payment Deadline:
The Buyer is required to pay for the placed order within 3 days from the date of placing the order. Otherwise, the order will be canceled by the Seller.
§ 7. Delivery
- Delivery is carried out within the territory of Poland and Germany.
- Deliveries are made via courier shipment.
- Delivery costs are borne by the Buyer.

1. The buyer has the right to withdraw from the contract in writing without giving any reason within 30 days from the date of taking possession of the goods (withdrawal within 14 days - refund to a bank account, withdrawal after 14 days and before 30 days - refund to a gift card).
In the event of written withdrawal from the contract, the Customer is obliged to return the goods within 14 days. The right referred to above also applies to a natural person concluding a contract directly related to their business activity, when the content of the contract indicates that it is not of a professional nature for that person, resulting in particular from the subject of their business activity, made available on the basis of the provisions on the Central Register and Information on Economic Activity. - A Buyer who is a consumer withdraws from the agreement by submitting a statement in written form (download form) or via the online return form (https://bobuxpolska.pl/EN/return).
- In the event of withdrawal from the contract, the contract is considered not concluded. The services and goods exchanged by the parties must be returned unchanged, unless the change was necessary within the limits of ordinary management.
- The refund will be made within fourteen days from the date of receipt of the Buyer‘s withdrawal statement.

In the event of the Buyer's declaration of withdrawal from the contract and return of the purchased goods within 14 days, the Customer is entitled to a refund to the bank account from which the purchase was made.
In the event of withdrawal from the contract after 14 days and before 30 days from the date of taking possession of the goods, the funds will be refunded to a gift card, which can be used in the Shop for a period of 12 months from the date of refunding the funds to the card. - The Customer bears the cost of returning the product to the Seller.
- The goods should be sent to the address: HYPER (returns), ul. Gajowa 1, 43-100 Tychy, Poland (courier contact number: +48 518-240-104).
- The Seller may withhold the refund of payments received from the consumer until the goods are returned or until the consumer provides proof of having sent the goods back, whichever occurs first.
- If the entire order is returned within 14 days, we will also refund the costs of delivering the goods to the customer.
§ 9. Complaints under Warranty
- In accordance with applicable law, each product purchased in our store is covered by a 2-year warranty.

A Customer may submit a complaint by:
- completing the online complaint form (https://bobuxpolska.pl/EN/complaints) and sending the complete product received in the transaction to: HYPER (complaints), ul. Gajowa 1, 43-100 Tychy, Poland (contact number for courier: +48 518-240-104)
or
- clearly completing the complaint form (download form), attaching it to the complained product, and sending it to: HYPER (complaints), ul. Gajowa 1, 43-100 Tychy , Poland (courier contact number: +48 518-240-104). - We will respond to the complaint within 14 days from the date the complained product is delivered to us.
§ 10. Disputes
In the event of any disputes between the Buyer and the Seller, the Buyer may use out-of-court complaint and redress procedures. The Buyer may, among others:
- apply to the permanent consumer arbitration court operating at the Trade Inspection with a request to resolve a dispute arising from a concluded Sales Agreement,
- apply to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings for an amicable settlement of the dispute with the Seller,
- obtain free assistance in resolving a dispute by using the services of a district or municipal Consumer Ombudsman or a consumer protection organization whose statutory tasks include consumer protection, such as the Consumer Federation or the Polish Consumers Association.
§ 11. Final Provisions
- All mentioned products and names are used for identification purposes only and may be registered trademarks of their respective manufacturers.
- bobuxpolska.pl is a domain owned by HYPER sp. z o.o.
- By placing an order, the Buyer agrees to the storage and processing of their data for marketing purposes by the Seller. This data is confidential and will not be disclosed to third parties. The Customer has the right to access their personal data, make corrections, and request its removal from the database. The Seller undertakes to protect personal data in accordance with the Act of 29 August 1997 on the Protection of Personal Data.
- In matters not regulated by this document, the relevant provisions of the Civil Code (Journal of Laws No. 16, item 93, as amended), the Act on Special Conditions of Consumer Sale and Amendments to the Civil Code (Journal of Laws No. 141, item 1176, as amended), the Act on the Provision of Electronic Services (Journal of Laws No. 144, item 1204, as amended), and the Consumer Rights Act (Journal of Laws of 2014, item 827) shall apply.
- The offer presented in the Store does not constitute an offer within the meaning of the Civil Code but only an invitation to negotiate (pursuant to Article 71 of the Civil Code).
